Red Peak

Hosting Terms

Version 1 · Effective 14 October 2026

These terms apply to the website hosting we provide. We have kept them short and in plain language. If anything is unclear, please ask us before you accept them.

1. Who we are

“Red Peak”, “we” and “us” mean Ruan Pienaar, trading as Red Peak, a sole proprietor based in Cape Town, South Africa. “You” means the person or organisation whose website we host.

You can reach us at ruanmpienaar@gmail.com or on 082 780 0689. Formal notices under these terms, such as cancellation, are given by email to that address and to the email address we have for you.

2. Accepting these terms

You accept these terms by confirming in writing, including by replying to our email, or by paying an invoice that refers to them. If you accept on behalf of an organisation, you confirm that you are authorised to do so. These terms, together with your invoice, are the whole agreement between us for hosting.

3. What is included

  • Hosting your website on our cloud server in South Africa (Johannesburg).
  • An SSL certificate, so your website is served securely over https.
  • Monitoring of your website and the server, with alerts to us when something goes wrong.
  • Daily backups of your website's database and uploaded files, kept for 14 days, and restoring them on request.
  • Applying server and security updates.
  • Reasonable support by email or phone for questions about your hosting.

4. What is not included

The following are not part of the hosting fee. We are happy to help with them, but we will quote first and only start once you agree:

  • Changes to your website's content, design or functionality, and new features.
  • Fixing problems caused by changes made by you or by another developer.
  • Domain name registration and renewal, and email hosting, unless we have agreed in writing to provide them.

5. Fees and payment

The monthly hosting fee is the amount shown on your invoice, in South African rand. We invoice monthly in advance, and each invoice is due within 7 days. We may change the fee no more than once in any 12 months, and only after giving you at least 30 days' notice by email. If you do not accept the new fee, you may cancel before it takes effect.

6. Late payment

If an invoice is still unpaid 14 days after its due date, we will remind you. If it is still unpaid 7 days after that reminder, we may suspend your website until the account is paid. Suspending a website does not delete it: we keep it for at least 30 days, and restore it promptly once you have paid.

7. Cancelling

Hosting runs month to month, with no fixed term. Either of us may cancel by giving 30 days' notice by email. Fees already paid for the current month are not refunded.

8. When you leave

Once your account is paid up, and if you ask, we will give you a copy of your website's files and database within 10 business days, at no extra cost. We keep your website for 30 days after the service ends and then delete it. Backups are deleted as they reach the end of their 14-day cycle.

9. Your domain name

Your domain name belongs to you. If we register or manage it for you, it is registered in your name, and we will help you transfer it whenever you ask.

10. Your content

You are responsible for the content on your website and for having the right to use it. Your website may not be used for anything unlawful, to send spam, or to spread malware. If your website is hacked or misused in a way that puts the server or other clients at risk, we may take it offline straight away to protect them. We will tell you as soon as possible and work with you to get it back online.

11. Availability

We work to keep your website online at all times, but no hosting service can promise that it will never be interrupted. Where possible, we schedule maintenance outside business hours. Backups are a safety net, not a guarantee that no data can ever be lost.

12. Personal information (POPIA)

Your website may hold personal information, such as messages sent through a contact form. Under the Protection of Personal Information Act, you are the responsible party for that information and we are your operator. We will:

  • process it only to host your website, or as you instruct us;
  • keep it confidential, and not sell it or share it with anyone except the infrastructure providers we need to host it;
  • keep it in South Africa, and protect it with appropriate, reasonable technical and organisational security measures;
  • tell you without undue delay if we have reason to believe it has been accessed or acquired by someone without permission; and
  • return or delete it when our service ends, as set out in clause 8.

13. Limits on our liability

Please read this clause carefully. It limits what you can claim from us.

As far as the law allows, we are not liable for indirect or consequential loss, such as lost income, lost profits or lost business, caused by your website being unavailable or by data being lost. Our total liability to you for any claim is limited to the hosting fees you paid us in the 3 months before the claim arose. Nothing in these terms limits our liability for gross negligence or fraud, or any right you have that the law does not allow us to limit.

14. Changes to these terms

If we change these terms, we will publish the new version on this page with a new version number and date, and email you at least 30 days before it takes effect. If you do not agree with the change, you may cancel before it takes effect. Previous versions are available on request.

15. General

These terms are governed by the law of South Africa. If we disagree about something, we will first try to resolve it by talking to each other. If any part of these terms is found to be invalid, the rest still applies.
